In order to improve the intellectual resources introduction in Tianjin Economic and Technological Development Area (TEDA), which includes granting working permit in China to foreign experts, qualification confirmation of retaining institutions, qualification confirmation of the oversea organizations that introduce foreign cultural and educational experts to work in China and qualification confirmation of organizations that arrange teams and individuals to be trained overseas, Implementation Regulations for Intellectual Resources Introduction in TEDA (trial one) is set up according to the Notice About Administration of Foreign Expert Certificate Issued by State Administration of Foreign Experts Affairs (No.139 documents [2004] issued by Foreign Expert Bureau).

I. Transaction prescription for the qualification confirmation of the oversea organization for introducing foreign cultural and educational experts to work in China

A. Application requirements:

The oversea organization that applies for the qualification confirmation of the oversea organization for introducing foreign cultural and educational experts to work in China needs the following requirements:

a. artificial-person organization

b. unreligious group

c. having capability of introducing foreign cultural and educational experts

B. Application materials

a. application form of the qualification confirmation of the oversea organization for introducing foreign cultural and educational experts to work in China

b. legal proof documents issued by the local authorities that the oversea organization is located in

c. capital and credit proof documents issued by the local financial organization that the oversea organization is located in

d. introduction of the oversea organization

e. resume (educational background, working experience) of the artificial person of the over-sea organization

f. copies of the registration certificate issued by relevant TEDA departments to the resident office of the oversea organization in TEDA

C. Time limit

Within 45 working days

II. Transaction prescription for the qualification confirmation of the retaining institution

A. Application requirements:

The institution that applies for the qualification confirmation of the retaining institution needs the following requirements:

a. having the qualification of independent artificial person

b. having the qualification confirmation of its industry

c. setting up the special institution for the management and service for foreign experts and being equipped with well-qualified staff

d. perfect system for foreign experts management and foreign affairs staff

e. having working conditions, life facilities and security capability for retaining foreign experts

f. expense guarantee for retaining foreign experts

After new schools and other educational or training institutions are run for over 1 year and the teachers, students and teaching order are stable, they can transact the procedure for qualification confirmation. But formal Chinese-foreign joint teaching institutions and schools only for children of foreigners are not limited by the regulation.

B. Application materials

a. application report for the qualification confirmation of the retaining institution issued by the TEDA Labor and Personnel Bureau;

b. application form of the qualification confirmation of retaining foreign experts;

c. qualification certificate of artificial person;

d. management system including seurity system for foreign experts and working system for staff in the retaining institution;

e. cerfiticate or credentials of industry permit;

f. private teaching or training institution needs submit the copies of house property certificate or leasing agreement of the teaching place and capitial and credit proof issued by the opening bank of the applying institution.

C. Time limit

Within 75 working days

III. Transaction prescription for the qualification confirmation of the institution for organizing and dispatching teams and individuals to be trained overseas

A. Application requirements:

a. intitution for organizing official teams or individuals to be trained overseas

1. having special organization and staff for dispatching teams and individuals to be trained overseas;

2. having perfect regulations and rules for dispatching teams and individuals to be trained overseas. The application institution should set up its own regulations and rules based on its working practice and relevant national demands for official training overseas;

3. specific scope of business. The institution which applies for official training overseas should have specific bounds for the team and contents;

4. for non-profit goals;

5. the funds for oversea training not less than 500 thousand RMB annually and individuals being trained overseas not less than 80;

6. quantity-limited principle for the qualification confirmation of the institution for organizing official teams and individuals to be trained overseas and no repeated confirmation for the same business in the same area.

b. the instituion for private training overseas

1. The arfitical person should be the permanent Chinese citizen with complete civil capability;

2. If the applicant is an instituition, it should accord with the demands for the institution artificial person and the artificial person should accord with the relevant regulations of the registration management for the delegate of the institution;

3. There are staff who are familiar with the relevant policy and regulations for training in China and foreign countries. The number is not less than 5 and the main staff should have associate bachelor degree or above. The institution must have staff who have qualification in law, foreign languages and accounting.

4. There are regualtions and rules for organizing and dispatching teams and individuals to be trained overseas.

5. The registered capital should be not less than 15 million RMB.

6. The reserve funds should be paid for the compensation, amercement and fine to the service object when the legal rights are infringed.

B. Applicaiton materials

a. The institution which organizes official training overseas should submit the following materials:

1. application form of the qualification confirmation of the institution which organizes and dispatches teams and individuals to be trained overseas;

2. For social groups, it should submit the copies of the constitution and registration certificate of the social groups and for institutions, it should submit the copies of permitting document from its superior department;

3. regulations and rules of the organization for the oversea training;

4. proof of the funds source for the oversea training;

5. letter of intent or agreement of cooperation (in Chinese and foreign languages) signed with oversea training organizations.

b. The institution which organizes private training overseas should submit the following materials:

1. application form of the qualification confirmation of the institution which organizes and dispatches teams and individuals to be trained overseas;

2. resume and relevant identity and qualification proof of the artificial person, main principal and main staff;

3. capital-examining report from the capital-examining institution with legal capacity;

4. proof of the artificial person's qualification or notice of the name approved in advance of the institution;

5. institution's constitution and inside regulations and systems;

6. feasibility report of the oversea administrative area for the oversea training;

7. proof of the use of the residence and business location;

8. letter of intent or agreement of cooperation (in Chinese and foreign languages) signed with oversea training organization.

C. Time limit

Within 75 working days
