Management Method for Administration of Foreign Expert Certificate Issued by TEDA(draft with suggestion required)

In order to standardize the procedure of administration of Foreign Expert Certificate and totally cooperate with the management and service for foreign experts in TEDA of Tianjin Administration of Foreign Expert Affairs, and according to relevant rules and regulations of SAFEA, referring to statutes of TAFEA, Management Method for Administration of Foreign Expert Certificate Issued by TEDA has been set up.

I Foreign Expert Certificate (cultural and educational category) for foreign experts with job visa (category Z)

1. The requirements:

Foreign experts who apply for Foreign Expert Certificate (cultural and educational category) should be the professionals with foreign nationality and observe Chinese laws, be healthy, have no criminal record and be employed in China for education, scientific research, press and publishing, culture, art, sanitation and physical education. At the same time, foreign experts should be bachelor or above and have work experience for 5 years or above in certain specialty (for language teachers, they should be bachelor or above and have work experience for 2 years or above in certain specialty).

2. Application time:

Foreign experts with job visa (category Z) working in TEDA should hand over relevant application procedure for Foreign Expert Certificate (cultural and educational category) in Tianjin Binhai center of China International Talents Market within 15 days.

3. Applicants

Foreign Expert Certificate (cultural and educational category) should be applied by the foreign expert or the retaining institution. The retaining institution applying for Foreign Expert Certificate (cultural and educational category) for foreign experts should gain qualification for retaining foreign experts in Tianjin and also get Qualification Certificate for Retaining Foreign Experts.

4. Application materials and relevant explanation

a. foreign experts with Work Permit in China for Foreign Experts should submit materials as follows:

a) the copies of Work Permit in China for Foreign Experts

b) original one and copies of valid visa and job visa (category z) of foreign experts

c) one 2-inch face photo without hat of foreign experts.

b. foreign experts without Work Permit in China for Foreign Experts should submit materials as follows:

a) resume with educational and working experience. It should be independent of the application form and be detailed. Educational experience should be from bachelor degree or the highest degree without bachelor degree; and working experience refers to the experience in the former institution before coming to the retaining institution.

b) copies of the certificate of the highest degree or certification materials of professional qualification. The certificate of the highest degree should be proved by foreign educational department or the graduation institution of the experts. The certification materials of professional qualification refer to the credence issued by relevant specialty organization for proving the professional level of the foreign experts. When applying by retaining institution, the certificate of the highest degree or certification materials of professional qualification should be translated into Chinese.

c) health certification. The certification is the valid prove of the health of the experts. It should be issued by foreign medical institutions qualified by Chinese embassy and consulate in foreign countries or sanitation and quarantine departments appointed by Chinese government with validity period over 1 year.

d) retaining agreement or contract. The contract should be the standard retaining contract printed by SAFEA signed by the foreign expert and the retaining institution.

e) original one and copies of valid visa and job visa (category z) of foreign experts

f) one 2-inch face photo without hat of foreign experts.

g) relevant certification of medical insurance in Tianjin for the foreign expert and family members. The certification can be the special item of medical insurance purchased by the retaining institution for the foreign expert and family members or the medical insurance overseas purchased by the foreign expert before coming to China. The insurance purchased should cover the fee for major disease and the fee in hospital of the foreign expert and family members when working in Tianjin.

II Foreign Expert Certificate (economic and technical category) for foreign experts with job visa (category Z)

1. The requirements:

Foreign experts who apply for Foreign Expert Certificate (economic and technical category) should observe Chinese laws, be healthy, have no criminal record and accord with one of the following requirements:

a. professional technical or managerial staff with foreign nationality who is employed in China for carrying out agreement or pact between governments or international organization and trade contract between China and foreign countries;

b. advanced professional technical or managerial staff with foreign nationality who is employed to be a deputy general manager or above in the enterprise within Chinese boundary and is bachelor or above and have work experience for 5 years or above in certain specialty;

c. delegate of resident representative office in China of overseas experts organization or talents agency ratified by SAFEA;

d. urgent professional technical or managerial staff with foreign nationality who is employed in China to engage in economic, technical, engineering, trade, financial, accounting, tax and traveling field and so on with specialty.

2. Application time:

Foreign experts with job visa (category Z) working in TEDA should hand over relevant application procedure for Foreign Expert Certificate (economic and technical category) in Tianjin Binhai center of China International Talents Market within 15 days.

3. Applicant:

Foreign Expert Certificate (economic and technical category) should be applied by the foreign expert or the retaining institution

4. Application materials and relevant explanation

a. foreign experts with Work Permit in China for Foreign Experts should submit materials as follows:

a) filled-in application form for foreign expert certificate (logging in the website http://www.bhijob.com； http://www.safea.gov.cn；http://www.teda.gov.cn/cms/cms/website/myfzj/bgxz/index.htm to download).

b) the copies of Work Permit in China for Foreign Experts

c) original one and copies of valid visa and job visa (category z) of foreign experts

d) two 2-inch face photos without hat of foreign experts.

e) relevant certification of medical insurance in Tianjin for the foreign expert and family members. The certification can be the special item of medical insurance purchased by the retaining institution for the foreign expert and family members or the medical insurance overseas purchased by the foreign expert before coming to China. The insurance purchased should cover the fee for major disease and the fee in hospital of the foreign expert and family members when working in Tianjin.

b. foreign experts without Work Permit in China for Foreign Experts should submit materials as follows

Article 1 Section 1: foreign expert need submit copies of relevant project agreement and permit;

Article 1 Section 2: foreign expert need submit copies of appointment document of enterprise or employment contract;

Article 1 Section 3: foreign expert need submit documents permitted by resident representative office in China and appointment document to be foreign delegate or other copies of dispatch documents with forced effect;

Article 1 Section 4: foreign expert need submit copies of employment agreement or contract.

f) original one and copies of valid visa and job visa (category z) of foreign experts

g) two 2-inch face photos without hat of foreign experts.

h) relevant certification of medical insurance in Tianjin for the foreign expert and family members. The certification can be the special item of medical insurance purchased by the retaining institution for the foreign expert and family members or the medical insurance overseas purchased by the foreign expert before coming to China. The insurance purchased should cover the fee for major disease and the fee in hospital of the foreign expert and family members when working in Tianjin.

III Foreign Expert Certificate for foreign experts with traveling visa (category L) or visitation visa (category F)

1. The requirements:

Foreigners who have special reasons for being unable to transact job visa (category Z) in time and accord with one of the following qualifications with traveling visa or visitation visa can transact relevant category foreign expert certificate according to the following conditions:

a. advanced consultant invited by provincial state department or hi-tech and high-level managerial staff of national and provincial hi-tech cooperation item, key engineering agreement and talents exchange project between the state or local government and foreign countries;

b) staff with great contribution for the state and society and staff who carry out the inter-state free aid agreement;

c) academic or scientific research header employed by state and provincial research institution or key high-education institute and vice professor or vice researcher or above employed by relevant institution or academic and scientific research core member having the same treatment;

d) deputy general manager or above in enterprise or institution or advanced managerial and key professional staff having the same treatment;

e) staff who invest 3 million US dollars in TEDA or managerial and professional staff dispatched to TEDA by foreign enterprise or other economic organizations which accord with the above conditions;

f) overseas Chinese who obtain international great scientific prize and other outstanding or key overseas Chinese.

2. Application time:

Foreign experts with traveling visa (category L) or visitation visa (category F) working in TEDA should hand over relevant application procedure for Foreign Expert Certificate (economic and technical category) in Tianjin Binhai center of China International Talents Market within 15 days.

3. Applicant

Foreign Expert Certificate should be applied by the foreign expert or the retaining institution in TEDA.

4. Application materials and relevant explanation

d) original one and copies of valid visa and traveling visa (category L) or visitation visa (category F) of foreign experts

e) two 2-inch face photos without hat of foreign experts.

f) relevant identity certification documents:

Article 1 Section 1: foreign expert need submit the copies of the appointment letter (certification document) issued by provincial state department or of relevant project agreement and project ratification letter and the certification document for the expert participating in and carrying out the project;

Article 1 Section 2: foreign expert need submit the copies of the certification documents for the great contribution or of inter-state free aid agreement and the certification documents for the expert participating in the aid project in person;

Article 1 Section 3: foreign expert need submit the copies of employment agreement of the retaining institution or professional technical qualification certificate (certification document);

Article 1 Section 4: foreign expert need submit the copies of the appointment letter of the retaining institution or employment contract;

Article 1 Section 5: foreign expert need submit the copies of the capital examination report issued by accountant office, contract regulations of the foreign enterprise permitted by Commercial committee and appointment letter or employment contract (agreement);

Article 1 Section 6: foreign expert need submit the copies of prize certificate or relevant certification documents.

g) foreign experts who apply for Foreign Expert Certificate (economic and technical category) need submit the filled-in application form for foreign expert certificate (logging in the website http://www.bhijob.com； http://www.safea.gov.cn；http://www.teda.gov.cn/cms/cms/website/myfzj/bgxz/index.htm to download).

IV Procedure for extension and change of Foreign Expert Certificate

1. Foreign expert need submit the following materials by himself or the retaining institution to Tianjin Binhai Talents Market for the extension procedure:

a. copies of employment agreement, contract or appointment letter of foreign experts.

b. original one and copies of valid visa and job visa (category z) of foreign experts.

c. original one of the Foreign Expert Certificate needed extension.

2. Procedure for the change of Foreign Expert Certificate

a. Foreign expert need submit the following materials by himself or the retaining institution to Tianjin Binhai Talents Market for the change of working institution of foreign experts:

a) copies of employment agreement, contract or appointment letter of the new retaining institution of foreign experts.

b) original one and copies of valid visa and job visa (category z) of foreign experts.

c) foreign expert need submit the recommendation letter of the header of the original employed institution if the working change happens within the term of contract or agreement of the original employed institution.

d) original one of the Foreign Expert Certificate needed change

b. Foreign expert need submit the following materials by himself or the retaining institution to Tianjin Binhai Talents Market for the change of the name of the retaining institution or the name or passport of the foreign expert: application letter for change of the retaining institution including the reason and contents, etc of the change of Foreign Expert Certificate.

V Procedure for writing off the Foreign Expert Certificate

1. If foreign expert who has Foreign Expert Certificate finishes working ahead of schedule for some reason, he need submit the application report of applying for writing off the certificate to Tianjin Binhai Talents Market and original one of the Foreign Expert Certificate to transact the procedure;

2. If the contract of the foreign expert expires and he doesn’t remain in office, the retaining institution need submit the original one of the Foreign Expert Certificate within 1 month to Tianjin Binhai Talents Market to transact the procedure.
